dear mr. geller,
several comments:
1. ours are not new complaints.
2. may we formally accept that you have now moved away from grooveshark's prior position as articulated by your mr. custer (12aug2011): King Crimson content has been delivered to us by our label partners?
3. mr. custer notes, in his snippy fashion (16aug2011): We continue to process all properly formatted DMCA takedown notices (you can access our web form here http://www.grooveshark.com/dmca) and remove infringing material at an industry leading pace… We are however making great strides towards the next generation of highly automated filter systems that we hope will allow content owners to more easily police unauthorized content on UGC and blended services.
(i am unable to determine whether mr. custer's unfortunate tone of voice/writing derives from his profession of law, or drumming, or whether his nature is just, well, kinda snippy).

... new complaints should move smoothly. I direct you to the complaint form because our takedown process is streamlined through there…
two points in response:
i) is groovehsark incapable/unwilling of/to policing/preventing unlicensed material from being placed/appearing on your site?
ii) it is not my responsibility to monitor your site. it is your responsibility to prevent material being improperly made available, in the first place; and to remove it, in the second.
4. may we accept that those of your employees tasked with clearing up your discrepancy have an ongoing job; and that it is their job, not mine/ours? and that this is not a discrepancy, but also an ongoing issue?
5. i attach a (not quite complete) screencap from today of the KC material currently available on your site.

There are also the latest UMG arisings, which I have been asked not to include in the Diary. The UMG position, IMO, is increasingly untenable. The conventional behavior of companies in the wrong strike me as pretty dopey: bullying, threats, yes; owning-up and provision of information, ie full disclosure – not.
